Deputy Schanz "Witnessed a vehicle leaving a high traffic drug area" that "committed a traffic offense" and a pursuit began northbound on US 377 in Johnston County, OK. 

Per a written statement by Sheriff Gary Dodd "At one point, the suspect took his vehicle and struck Tishomingo Officer Jonah Wise's patrol unit".  Further statement by Dodd said that his Deputy, Ty Richeson, used a "Tactical Vehicle Intervention" that caused the suspect vehicle to roll onto it's side.    Law Enforcement states that the suspect, Mark Crawley, "refused" to exit the vehicle and "forced" deputies to "bust out" the windshield of Crawley's vehicle and "fight" the suspect, this resulted in "minor injuries" to the Deputies.  On scene and booking photos show Crawley with blood running down his face from a head injury, whether  the"TVI" maneuver or the "fight" with deputies was the cause of Crawley's injuries are unknown.

Per Probable Cause Affidavit sworn upon oath by Deputy Schanz:

  • Schanz "observed" the vehicle idling beside a camper as he passed an RV Park he states is "known to me as a high crime area"
  • Schanz waited for the vehicle to leave, the followed the vehicle "in an attempt to find probable cause to preform a traffic stop"
  • Deputy Ty Richeson waited in a different location, then began to follow behind Deputy Schanz.
  • Schanz affirms: "I was unable to gain probable cause to preform a traffic stop" and the vehicle pulled into a convenience store parking lot.
  • Schanz waited for the vehicle to leave, but not before requesting Deputy Richeson to "see if the subject's front windshield is cracked".
  • Schanz waited for the subject vehicle to leave the convenience store "to initiate a traffic stop based on that traffic violation".
  • Upon initiating his emergency lights, the subject "accelerated and gave chase"
  • Pursuit reached speeds of approximately 40-50 mph approaching an elementary school and 50mph through residential streets
  • The subject stopped at his residence, where Deputy Schanz drew his service pistol and ordered the subject out of the vehicle.  The subject "accelerated again and the chase continued".
  • Schanz attempted to cut off the subject vehicle, "however he was coming straight for me.  I then drew my service pistol with the intention of using lethal force"
  • Schanz made a 2nd attempt to "cut him off once more but was unsuccessful, and he collided with Tishomingo Police Officer Jonah Wiss and began driving at a high rate of speed"
  • Richeson struck the rear of the subject vehicle "due to [subject] slamming on his breaks".
  • "We reached speeds up to100 mph" leaving city limits.
  • Subject slams breaks, then turns into a driveway and "rams gate" before driving into a pasture
  • Schanz: Subject "was attempting to weaponize his vehicle and use it to ram another law enforcement" ; "I once again was preparing to use lethal force against [subject]"
  • Richeson used his patrol vehicle and struck subject vehicle on the rear bumper which caused the vehicle to roll (Possible TVI/PIT maneuver). 
  • Schanz, Richeson, and Deputy Murray approach the disabled vehicle "with weapons drawn" and ordered the subject out of the vehicle.  "Hewas refusing to comply" so Schanz was then "forced" to "kick out the rest of the windshield with the help of Deputy Richeson."
  • Once the subject was "dragged from the vehicle" Schanz states in his affidavit that he "then delivered a closed fist strike to [subject]'s abdomen" before he "struck him once more in the jaw with a closed fist" before then getting "into a full back mount, and placed him in a carotid restraint, but did not apply enough pressure to render him unconscious"

 

A carotid restraint is a "chokehold" type restraint that according to the Department of Justice is to be considered lethal force and it's use is only justifiable when  "the officer has a reasonable belief that the subject of such force poses an imminent danger of death or serious physical injury to the officer or to another person." Any technique used to restrain an individual which restricts breathing or occludes both carotid blood vessels simultaneously.


Inappropriate lethal force refers to the use of deadly force by a police officer in a manner that is not justified by the circumstances or that exceeds the level of force necessary to resolve a situation.
