Statement

Deputy Lapointe was working a temporary roadblock when the victim and other cars approached and stopped at the corner to turn onto the road they lived on.  Deputy Lapointe was partially blocking the road, but remained in his car, not controlling traffic as was his duty. The victim crept  his car closer and closer to get the Deputy's attention and to respond and control traffic. Deputy Lapointe exited his car, argued and verbally abuse the victim, by telling him to “Get the hell out of here”.  The victim responded by swiftly accelerating away from the corner.  Deputy Lapointe responded by jumping in his patrol car, flooring the gas pedal, and screeching his wheels to pull over the victim.  The deputy demanded the victim forfeit his constitutional right of privacy and provide his ID, falsely stating he failed to yield, drove fast, fishtailing (reckless), and screeched his tires. Deputy Lapointe would go on to complete false citations and refuse to call his supervisor, as requested by the victim numerous times.

Definition of Offense(s)

Police corruption is the abuse of police authority for personal gain. Corruption may involve profit or another type of material benefit gained illegally as a consequence of the officer's authority.

False statements by a police officer fall under the category of police misconduct and refer to instances where a police officer deliberately makes false or misleading statements under oath, in official reports, or in any other official capacity.

The term police misconduct refers to illegal or inappropriate action engaged in by law enforcement officers.

Law enforcement personnel are held to personal standards higher than other members of our communities. Conduct unbecoming has been a common and historical charge used in controlling and censuring police officers and other public employees, for both on and off duty actions.

Police brutality is the use of excessive and unnecessary force on the part of a police officer when he is interacting with a civilian, resulting in a violation of the civilian’s civil rights.
