Complaint No. 1782359933 - 590186524

Tina R. Ainley

Statement

“Judge Tina Ainley advanced my case and issued orders based on a defective and irregular preliminary‑hearing waiver. The waiver packet contains conflicting dates, duplicate pages, and no clear defendant signature, yet Judge Ainley repeatedly treated the preliminary hearing as waived. For example, the waiver form states ‘DO NOT SIGN THIS FORM IF YOU WANT A PRELIMINARY HEARING,’ but the version in the record shows inconsistent dates and signatures, including a second copy signed months later.”

“Despite these defects, Judge Ainley issued orders stating, ‘The Preliminary Hearing in this matter is waived,’ and directed that the Information be filed.”

“Judge Ainley also vacated my scheduled 3‑day jury trial without my knowledge or consent. Her order states: ‘IT IS FURTHER ORDERED vacating the 3‑day Jury Trial set to commence… on December 14, 2022.’”

“She simultaneously vacated my pretrial conference and reassigned my case through a transfer process originating from Judge Bluff’s division only 21 days before trial. The order states: ‘This matter having come before the Court for Case Transfer Process… from Division 7,’ and then reassigns the trial to Division 4.”

“These actions occurred without any notice to me, without a hearing, and without any signed waiver from me. All other parties — the prosecutor, public defender, and both judges — were notified, while I was not. This deprived me of meaningful notice, stability, and due process.
