Statement

The officer was listed as a victim in a case that took place on 12/3/2022 where the officer failed to lock his vehicle in which someone breached the vehicle and removed property. The officer claimed that he took his rifle plates in his home with him along with his firearms on his original statement on 12/3. The officer then engaged in investigation activity regarding the case, modified police reports where he has substantial financial gain from the outcome, played a role as investigator / evidence collector / evidence submitter/reporting officer/radeofficer that resulted in over 75,000 worth of damage to the "suspects" property and vehicles. Supposedly the officer located a vehicle that had his gear in it from the Tucson Police department. The officer failed to safe keep confidential police records in a safe place where it was obtained without forced entry based on the report made by the officer. This is negligence for safe keeping personal identifying information, PCI. Based on the police reports, officer gearhart not only engaged in the investigation handled evidence, modified evidentiary reporting, supposedly located his gear in vehicle within a neighborhood, proceeded to investigate on a case where he was marked as a victim and engaged in activities that resulted in a massive show of force from the Tucson Police department where every single window in my home was busted out by the officers, intentional damage to my vehicles in the driveway not included on their search warrant or even within the scope of their search warrant. The officers walked up to my vehicle and pulled out their batons and beat my windows in and beat my car with their batons. Officer Gerhart submitted his documentation of the theft of items only AFTER THE WARRANT SEARCH UPON MY HOME DEC 15, PUTTING HIS REPORT AND LIST OF ITEMS ON 12/16/2022. The officer proceeded to engage knowing there is a clear conflict of interest and he could not act without bias. The officer also stood to get financial gain from the outcomes of the investigation. I strongly believe officer Gerhart along with three other officers modified evidence reporting and tampered with evidence to bring charges against myself and my fiance. Violating my constitutional rights and right to due process, it is evident that this officer engaged in activities that is a clear violation of the conflict of interest laws of Arizona. Based on the copies of discovery reports provided by Pima County prosecutors office, the copies of the police report clearly show edited by Sean Gerhart on evidence pages, trace evidence and modifying the original documentation of the report made on 12/03/2022. Within the documentation it also clearly has a statement from the officer himself stating that he managed identified transported and submitted evidence in where he is listed of victim and stands to have financial gain from the outcomes. The officer also advised that he took evidence of my home but it was not documented and he took it home with him. I am missing several items from my home and which I had to file a police report for which I cannot confirm or deny whether officer gearhart or another officer took the property or if the home was broken into after the fact because no no documentation was provided for what items officer Gerhart removed from my home and took as"his property".
