On or about May 17, 2023, Joshua FISTER, then an Operations Major with the Phoenix VA Police Department, engaged in inappropriate sexual conduct in the workplace. After a female VA employee exited the police office, FISTER made unsolicited sexual comments about her and simulated masturbation in front of a subordinate officer and others. A VA Harassment Prevention Program fact-finding was conducted, and on September 20, 2023, VA management issued a Memorandum of Record sustaining the allegation, concluding that FISTER engaged in conduct of a sexual nature. Management acknowledged that corrective action was taken. The sustained finding involves abuse of supervisory authority and may constitute impeachment material under Giglio/Brady due to its relevance to credibility and professional judgment.
