A civil lawsuit filed on January 6, 2023 [Pottawatomie County CJ-2023-00008] alleges that on November 3, 2021, while acting in his official capacity, David Dewitt, attempted to serve a search warrant on the wrong residence.  It is also alleged that he shot two dogs belonging to the residents.

On or about February 1, 2023, the case was formally removed from Pottawatomie County District Court to the United States District Court for the Western District of Oklahoma [Federal Court].
