A Federal Civil Rights suit filed on January 6, 2023, alleges six claims for relief: a 42 U.S.C. § 1983 claim against Deputy Justin Anderson for excessive force in violation of the Fourth Amendment to the United States Constitution (count one); a municipal liability claim against Vic Regalado arising from Anderson's alleged actions (count two); a municipal liability claim against Vic Regalado for failure to train or supervise (count three); punitive damages against Deputy Justin Anderson arising from alleged excessive use of force (count four); an Oklahoma state law claim for negligence against Regalado and Anderson (count five); and a 42 U.S.C. § 1983 claim against Anderson for unlawful arrest in violation of the Fourth and Fourteenth Amendments to the United States Constitution (count six).
The alleged incident occurred on November 25, 2021. The petitioner claimed Deputy Justin Anderson did a "suplex move", or backwards body slam that resulted in broken ribs and caused his lung to collapse when he slammed him to the ground in 2021.
Anderson was not placed on administrative leave from the incident, as the sheriff's office's internal affairs division found he didn’t violate department policy. Vic Regalado was dismissed from the lawsuit after Walker's legal team failed to show how he participated in the constitutional violations.
Tulsa County Commissioners agreed to pay law firm Wood, Puhl and Wood $250 an hour to represent Anderson and the sheriff in the case.
