On or about February 21, 2023, Deputy David Woody provided false statements in a probable cause affidavit resulting in criminal charges being filed in CM-2023-00103. The body camera evidence obtained through discovery in the case was evidence that the facts Deputy Woody affirmed were not true.
The defendant's lawyer filed a motion asking the court to order a giglio letter to be "created and kept by the government to inform any citizen in the future, should Deputy Woody be a witness against them".
The District 18 Assistant District Attorney's response concluded:
"To proceed with prosecution after discovering that the facts in a law enforcement officer's probable cause affidavit are so blatantly false and contrary to the actual events of an incident not only puts the State's credibility and integrity with its citizens and the courts at risk, but also jeopardizes due process and the criminal justice system."
The Honorable Tim Mills, admonished the deputy in a March 10, 2023 Order pointing out that the Deputy "lacks credibility" and ultimately dismissing the case without costs.
Local News reported on March 14, 2023 that the deputy was placed on unpaid administrative leave from the Pittsburg County Sheriff's Office following the ruling while an internal investigation is conducted.
