Upon answering a call of a suicidal man covered in lighter fluid, Officer Troy Nitzky deployed a bean bag projectile that struck Dustin Pigeon in the hip moments before officer Keith Patrick Sweeney fired his 9mm five times, three shots struck the subject, killing Mr. Pigeon.  

Captain Bo Matthews of the OKCPD told the press the shooting was in self defense, however Sweeney was later charged with Murder in the 2nd Degree.

Sweeney was later convicted of the murder of Pigeon, at the trial Sgt. Erik Howell testified that Pigeon didn't have a gun or a knife. "I did not observe any threatening acts," Howell said.
