Upon Deputies Joseph Schanz and Ty Richeson arriving to a residential alarm south of the Town of Mill creek, they engaged in a foot pursuit of a male subject.  Per Sheriff Dodd's social media post from the Official Johnston County Sheriff Facebook Page in which the subject was referred to as an "Oxygen Thief" by the "Aggravated" Sheriff; an altercation ensued between "the Deputy" and the subject, during which Ty Richeson deployed his JPX pepper gun.  

Per the Probable Cause Affidavit:

  • Both Deputies retrieved their "rifles" upon showing up to the scene (JCSO is issued AR15s)
  • Deputy Richeson received 7 stitches to his left knee from his fall during the foot pursuit
  • Deputy Schanz received a sprained wrist, elbow, shoulder, and knee from his fall during the foot pursuit
  • Deputies "lost sight" of subject for an undisclosed amount of time and returned to the residence
  • Richeson then left residence, and it is unclear how the subject then came into his custody.
  • Richeson deployed his JPX "Twice"
  • Schanz then "Took control" of the subject, "grabbed him by his shirt and pulled him towards me, then pushed him into the inmate seating area"
  • Schanz then states in his Affidavit: "I saw Undersheriff Smith grabbing [subject] and placing him on the ground" before being place into the patrol unit once again.
  • Schanz affirms in his statement that the subject was given multiple warnings to stop "smashing" his head against the plexiglass dividers in the patrol car, and told he would be sprayed with OC spray if he continued.
  • Schanz states he gave more verbal warnings, then stopped and exited the patrol vehicle, opened the door, and deployed OC spray to the subject's face.
