On June 16, 2024, I was awakened from my bed around midnight to the sound of a large crowd of 40-50 highly intoxicated people gathered in cars and on foot yelling and arguing in the street just in front of my home. Upon learning that the gathering stemmed from a disagreement that involved a relative and these neighbors I put on my clothing and shoes to attempt to de-escalate a situation that looked to be growing out of control in front of my home. As I spoke with the neighbors in the group there were a few who were visibly drunk and physically threatening. Lt. Richard Tyler Lents of the Pearl, MS Police Department arrived on scene while I was demanding that these drunk people leave from in front of my home causing the commotion. Upon Lt. Richard Tyler Lents' approach to me, he stated that "I was the one enticing these people to act this way" and I explained to Lents that I just got out here and that he didn't know what he was talking about, which made him become angry. Lt. Lents began to walk towards me aggressively, when I backed into my private property and front yard curtilage @355 Sweet Home Church Road. Lt. Richard Tyler Lents of Pearl Police Department then began screaming, "Get inside your house" while he stood in my front yard. Lents forced his way onto my private property screaming "Get your ass in that house!" while he stayed feet away from my face as he yelled," Get your ass in that house" all the while walking towards me which caused me to have to physically walk backwards through my front yard as to avoid contact with him as a law enforcement officer. @ 7 minutes and 40 seconds of the attached body camera footage of Lt. Richard Tyler Lents in Incident #202400012486 after being backed into my yard 30 to 40 feet by his unlawful commands to go inside my home during his verbal and physical threats, I state clearly to the Pearl Police Department, LT. Lents, "Hey man, get out of my yard, man please!" Which is where I verbally revoked any implied consent for him or any other officers of the Pearl Police Department to come onto my property which included my front yard, my driveway or my porch, without a warrant or exigent circumstances, and due to to this Supervising Lt.'s blatant hostility and anger. The screaming continued at me to "Get in the house" until he had backed me into my yard and up onto my porch for 75-85 feet into my Fourth Amendment Protected curtilage while screaming unlawful commands to "Get inside that house", despite me verbally revoking consent to be on my property and as he and other officers began entering my curtilage. @8:07 of this attached body cam footage, Lt. Lents raises his leg over 2 1/2 feet to step up and onto my attached front porch curtilage, without exigent circumstances or my consent while trespassing and peers at me through the closed glass front storm door screaming, "Stay yo' ass in that house", from my front porch that is as protected as if it were a room inside my home's threshold according to the 5th Circuit Case Law and the 4th Amendment as Lt. Lents remains on my porch for 14 seconds without legal authority or probable cause and without a warrant, despite having been told to get off my property. @ 8:16 of the attached Lents' body camera footage, my wife Morgan, who'd witnessed this unlawful and threatening behavior exhibited by Lt. Lents directed at me can be clearly heard saying to Lt. Lents who is still standing on our front porch threateningly, " Get away from my door", which was her First Amendment protected speech to assert that she wanted Lt. Lents away from her home and in "Fact" was the the second time Lt. Lents' implied consent to be on our property without a warrant or exigency was revoked by both of us homeowners. Lt. Lents steps off of our porch, walks towards my calm wife, and can be heard screaming, @8:18 of Lents' body cam footage, "You don't tell me what to do", "Shut yo' mouth!', "Shut yo' mouth!' to which my calm wife Morgan says, "You don't talk to us like that!" to which Lents responds, "You go in the house!" to which my calm wife Morgan replies, @8:25 of the Lents' body cam footage, "I don't have to go in my house because I'm on my property." Exactly 1 second later, @8:26 of this attached body cam footage, while standing beside our attached front porch in our yard, Lents states, "Okay, you're under arrest!" and places my calm and peaceful wife in handcuffs, for asserting her First Amendment right to verbally demand that this clearly angry and potentially violent police officer, that lacked a warrant, our consent or legal authority to be on our home's 4th Amendment protected curtilage. ( Lt. Lents narrative is a baseless lie on paragraph #6 that described my calm wife, as Leon's wife, began "Yelling at me as I was walking away, thus, causing another disturbance") After handcuffing and walking my wife across our front yard and down the street 180-200 feet, @9:10 of this attached Lents' body cam footage, my wife, still calm, asks Lt. Lents, " what are you taking me to jail for?" @9:12 Lents replies, "Failure to follow a lawful order, get in!" Lents shuts the cruiser back door with my wife in his custody. Lt. Lents turns to the drunken crowd @9:22 and peacefully says, "Please, everybody go home!" "Everybody" that Lents is referring to are described in these attached reports as being, 75 people in the front of Leon Seals' home at the intersection of Alexander Lane, who were parked in vehicles and on foot in a public roadway (Publicly Drunk) and stated in this report that " She had been drinking" and " they were under the influence", yet, not a single legal action was taken by Lt. Lents or any other officers of the Pearl Police Department, regarding the mob of publicly drunk individuals that traveled to the front of my home, parked their cars, and began to loudly argue. Lt. Lents had bigger fish to fry, like Mr. Leon Seals, who had beaten Lt. Lents in court earlier, in 2022, where all the charges were dismissed falsely filed against me, where on video cross examination video in my possession, Lents is quoted saying, "No Leon and me don't get along." This is why Lt. Lents allowed the instigating alcohol and drug induced and intoxicated mob of 75 people in this report, and I quote, "They were told to go home and sleep it off" to simply walk or drive away heavily intoxicated. @9:29 of this body camera footage, Lt. Richard Tyler Lents, steps his disgusting foot and re-enters my property without my consent, probable cause, a warrant, and after my wife and I both had revoked his and the Police Department's implied consent license and he walks 80 feet back towards my front porch where I stood, as I spoke to a much calmer Officer George about the events and me trying to calm the drunk mob down. When, @9:41 of this body cam footage of Lents', Lents can be heard screaming at me as he walks across my front lawn, "Didn't I tell you to go in the house?" When Leon Seals' mother says, "He's out here talking to this officer."(Referring to Officer Mike George) Lents screams at Leon Seals' mother, "I don't care, You see this?" (holding his Lt. coloured ensignia" as if it made him a Ruler) Lents looks at Officer George to imply he gives the orders around here and says, "I run this!"@9:51, as he snatches a second set of handcuffs from Officer George's belt. @ 9:56 Lt. Lents tells me, "Come with me....You're under arrest", as I stand on my front porch and ask Officer George to please keep this crazy man away from me, I move back towards my front door, @ 10:00 of Lents' body cam footage, Lents steps for the second time, up 2 1/2 feet onto my attached front porch in violation of my 4th Amendment for the 5th time this night, and as I stand holding my glass front door, @10:51, 1 second later, Lt. Richard Tyler Lents, fires his taser leads, while standing on my porch and into Leon Seals' body and electricutes me where I can be seen falling back inside my home where Lents and 2 Pearl Police Department officers walk through the threshold of my home and handcuff me, Leon Seals, for the initial arrest based on an unlawful order to remain "INSIDE" my home as a prerequisite "Failure to Comply- Disorderly Conduct" since I exited my home, after the unlawful command to stay inside, and since I stood on my attached porch and spoke to Officer George. @10:18 after my mother tells Lents," You ain't have no business tazing that man", Lt. Richard Tyler Lents then threaten my mother, for her protected speech and responds," Mama, you might want to come with me","Shutcha' mouth!" @ 11:17 of this attached Lents body camera footage, Lents states over the radio, and due to my civil rights activism in this and other communities regarding police brutality in the African American Communities, and for having beaten him in court earlier, Lt. Richard Tyler Lents proudly proclaims: "Leon Seals and his wife are in custody!" as if it were a badge of honor. There are Fifth Circuit Case law examples that reference the multitude of civil rights violations by Richard Lents of the Pearl Mississippi Police Department detailing the laws he broke and the civil rights he violated of Leon Seals, Meagan Seals and the regarding the sanctity of our home and its protected curtilage on this 16th night of June in 2024. The State of Mississippi (1968) (right to resist an unlawful arrest without violence for a non-violent misdemeanor arrest without a warrant or consent to be on the homeowner's property Payton and Lange U. S. Supreme Court opinions regarding "hot pursuit" of a non-violent misdemeanor allegation and the 4th Amendment right to be free from entry into curtilage United States v. Jones (2012) United States Supreme Court held that the 4th Amendment protects home owners when the governmental actor (trespassing upon a person's houses, papers, and effects) that enumerated and detailed : the front yard and porch Richardson v. Johnson, 598 F.3d 211 (5th Cir. 2010) revoking implied consent without a warrant and everything thereafter that occurred on the property was "Fruit of the Poisonous Tree" including resisting without violence McClish v. Nugent, 483 F.3d 1231 (11th Cir. 2007) Lt. Richard Tyler Lents is a threat to this community and therefore should be demoted or immediately decertified so that he cannot change departments and terrorize any other citizens We fully plan to file a 42 USC 1983 Civil Rights Lawsuit for Lt. Richard Tyler Lents' actions regarding this complaint in The Federal District Court for the Southern District of Mississippi in the next 3 months
