Statement

Officers involved are Luis Molina, Det-Kelly, Msgt-Collins and Jake Robinson. The date was 17th day of December 2023, the time it happened was between 7:00pm & 7:50. (Keep this in mind....after I was Released from them putting me in the handcuffs I asked them to check & loosen, because they were waayy to tight; Jake Robinson told me if I didn't run or if I wouldve cooperated, i wouldn't have gotten arrested, the charges against me are Resisting arrest and Obstructing Identification, I already mentioned the cuffs were way too tight, i was punched and tased. Upon officers arrival after they see two different complexion individuals having a verbal altercation of some type ... I told Robinson the cashier wanted me off the property though I didn't commit a crime and had no property belonging to anyone or the store. Robinson asked if I had anything belonging to the store I said no & I told him I have to go I have an emergency & he kept saying just wait & that it's an investigation to find out what happened & whats my name; they couldn't give me a CLEAR reason on why they stopped me & didnt put me in cuffs, I can't help them investigate that's their job & I mentioned I have an emergency(my oven at home is on). I told them I couldn't talk at all nor give my info and that I'm not under their Jurisdiction. I didn't commit a felony, trespassing isn't a crime against common law either I also mentioned I have a oven on that I left on 450 degrees before I left the house so many times. After I run i eventually I got caught on N Virginia Ave in someones back yard. It's this alley in the back of Virginia Ave that one of the officers went in & stopped in my path, he gets out, pulls the taser n yells "stop Resisting". I Turn around & run & went to the next house over I stop & let em get me, Officer comes up w taser; i surrender they knock to the ground even though I put my hands up & I peacefully surrendered It's dark so I can't see anything. My arms are under me because I fell on them from them knocking me down. Now They are on top of my back, I yell I didn't do anything, I start getting punched & they tased me on my back still not being violent to them, 2inches away from my spinal cord. My left hand was even free after I could get it free and nobody noticed. I waved it and everything. I was picked up and they aggressively put me on the front of the car. They illegal search me. More aggression when I was taken to the back of the car &;against the rear end now, I had to step off the curb and one of the officers thought I was "giving him a hard time" im going to say & made an Ignorant excuse as for the reason for it the "slamming" me against the car I was put into the car now. I noticed my wallet was missing and I told them to go get it however I didn't give consent to go in it ( the information on it isn't valid) I noticed the Handcuffs were cutting my circulation off fast & i go to try my best to knock on the inside of the door, I try to speak it loud enough for them to hear saying my hands hurt. Officer Luis Molina gets in and I mentioned to him they were tight. Multiple times. We're driving back to the gas station that I ran from to get home to cut the oven off. I asked him if I was Arrested and or Detained he couldnt give me a clear Answer. We arrive. I keep asking nicely to check the handcuffs; only this time I mention its a "special request" when someone complains about the handcuffs being tight. It was to the point my hand were tingling and I can't see so idk if it's turning colors, ( at one point I told him to crack the window because of the condensation building from me talking and no Miranda rights were ever read after being put in cuffs). I tell him you have to even check on me; not checking is wrong. I even tell him I'm not on no BS w him I just need these cuffs loose, mentioned I'd turn the opposite direction so it won't be easy for me to run or escape, he told me "they are fine" with out looking at them or checking them or anything. I yell out the cracked window requesting another Law Enforcement Agent to check & loosen the cuffs he tells Luis Molina to roll the window up & Molina listened to him and everyone ignored me, Which is a Duty to Intervene violation. I kept mentioning my stove is on idk if my house will catch fire, I have neighbors with offsprings. I even tell the squad cars cameras and audio thats recording that basically this treatment isn't right and basically using it as my witness to this treatment. I definitely realized Excessive Force for no reason with the handcuffs and taser (the fact I wasn't violent a taser shouldnt have been used). I didn't assault no officer at any point in this interaction with them. What I noticed that was violated: I didn't commit a felony so for them to search after running is a violation, My 1st 4,5 & 8th amendment were violated, My Civil Rights were violated My Privacy by unlawfully searching me & this is unconstitutional. They went against 42 USC 1983 as well. My wrist tingles till this day so I'm not sure how long this will last. I've filled a complaint with the department I included Pictures that I sent you all. I wrote a brief summary of the situation. I also requested the video footage of the body and squad car and I haven't heard anything not a email or phone call or in writing. I've filled out Civil violations complaints I've msged my local city council and Major. It seems like not one person seems to care about my Rights at all. I've even sent this matter to the Department of Justice and haven't heard anything.
