Statement

I am writing to bring to your attention an incident that occurred on December 12, 2022, at the Social Security office, where I was visiting to conduct business. Upon entering, I was asked to wear a face mask and politely declined, requesting an exception on the grounds of a medical condition. I was informed that the security guard would need to check with management and was permitted to stay until a decision was made. When informed that there was no exception, I requested the situation be documented in writing to hold those accountable if incorrect. The security guard, Kim Davenport, assigned to Paragon Security Systems as a security guard for the Social Security Administration, then asked me to leave and called the police. I explained that I would not leave a scene of a crime if one had been committed. My ticket number was called and the employee at the window did not have a problem with my not wearing a mask. Officer Leary then arrived and spoke with Davenport about the incident. During the interaction, I requested to take the conversation outside to avoid further disturbance and also requested a supervisor as I felt my civil rights were being violated. I was unaware that I could be trespassed from a public property without breaking any laws or causing any disturbance. Officer Julian Rioz arrived and we explained the situation to him, confirming that we were being trespassed from a public property without breaking any laws or causing any disturbance. During the encounter, Officer Rioz threatened to "put hands on us" and violated multiple policies, including not having proper handcuffs, leaning on Officer Nelson to search her vehicle for proper handcuffs and having Officer Nelson officiate the arrest even though he was the one who went hands on first. It should be noted that probable cause was not found after the "put hands on us" quote and multiple internal policies were violated in this incident, specifically policies 5.6.2, 5.6.5, 5.6.6, 5.6.7, 5.6.9, 5.6.22, 5.6.25, 5.6.27, 5.6.32, 5.6.35, 5.6.36, 5.6.37, 5.6.38, 5.6.39 and 5.6.42. As a sergeant who is now assigned to the force as of October, He is responsible for supervising and directing the work of patrol officers, assisting with the development and implementation of department policies and procedures, ensuring that officers under his command are properly trained and equipped, conducting investigations and making arrests
