Statement
On August 7th, 2022, approximately 10:30pm, after speaking with Officer Brennan at the park, and explaining I was there to get my wife because she came there to cool off after an argument he said no have a good night and I went home.
I got home and my neighbor left. While heading inside with my daughter the same officer I'd just spoken to arrived. He had no lights on at all nor did he announce the reason for his visit. He just asked why I ran from the park. I explained my neighbor was watching my kids and had to leave. Then he asked me why my wife and I were arguing. I ignored him and again began to walk inside my house. The officer then told me I was being detained but never indicated why. He walked over to me grabbing my arm. I pulled away asking why he was doing this. No response. My dog ran out to protect me. I grabbed him and got him and my daughter inside. While shutting the door the officer approached me grabbing my neck. I got out of the hold and ask him again what have I done? No response and soon after other officers arrived and tell me to get on the ground. I'm then told I'm going to jail for resisting arrest, child abuse and assaulting a cop. In the squad car the officer tells me he got a call about my wife and I arguing. I was taken to a substation without shoes and held for hours handcuffed awkwardly. Then taken to another holding facility. A woman can be heard crying and she peed on the floor. I was moved to that cell and made to walk through urine as the officer and detention officer smirked. Once I was read my chargers by the magistrate I was forced to walk home at 2am despite the arresting officer going in the same direction. This incident resulted because the officer never explained why he was there. He was visibly upset I didnt answer his question. So he used his power to unlawfully detain and arrest me as punishment. He wasn't even investigating a crime when he came to my house. He was performing a welfare check. If he stated the reason for the visit I wouldn't have ignored him. I complained to the assistant police chief the following day. Nothing was done. I asked to see the police footage and when I was able to view it the footage appeared to be missing most of the incident . I formally requested the footage in its entirety to defend myself in court. The police refuse to give it to me. I've lost my job as a result of this. My daughter has ptsd from this encounter and social service had to investigate. Of course they found nothing.I'm asking for someone to obtain the footage in its entirety. To investigate this officer and department. My wife Kerri Provost is witness.
