Failed to properly supervise his Assistant District Attorney Fern L. Smith in the June 1999 trial of Richard Glossip in which she was responsible for multiple brady violations.

  • ADA Fern L. Smith failed to preserve/disclose the "Sinclair Tapes" -
  • ADA Fern L. Smith failed to preserve/disclose the polygraph examination results (dispute exists as to if examination actually even occurred).
  • An Oklahoma Police Department Report indicated the District Attorney's Office ordered the destruction of evidence from the capital murder case to be destroyed in 1999, while on appeal.
