Statement

The arresting officer knowingly gave false testimony at a Rasmussen hearing and jury trial in a DWI case I was charged with. The arresting officer's name is Deputy Matt Hagen. The false testimony in question was a claim that he observed my eyes being bloodshot red and watery during the traffic stop(See exhibit 1 A lines 18-25 and exhibit 1B lines 1-4). Deputy Hagen was questioned about this claim on cross examination by my public defender and shown a clip from his BWC showing a clear view of my eyes. The video clip showed the Whites of my eyes and there was no "Bloodshot" or "glassy" condition of my eyes. Deputy Hagen admitted that my eyes were not bloodshot or glassy but proceeded to say "You can't see something like that in this video; there's not a enough detail"(See exhibit 2A lines 4-25 and exhibit 2B lines 1-25). It must be noted that Deputy Hagen never stated in his Peace Officer's certificate to Minnesota's Drivers and vehicle services that my eyes were watery(See exhibit 3). Deputy Hagen claimed in this certificate that my voice was "slurred"(See also exhibit 3) but he never testified to this at the Rasmussen hearing or my jury trial presumably at the behest of the Prosecutor Amanda Grossman, whom i'm assuming watched the video and did not hear any slurred speech. Amanda Grossman never questioned Deputy Hagen about slurred speech in the Rasmussen hearing nor the jury trial. Due to Deputy Hagen's false testimony my motion to Squash the arrest was denied and the Judge who presided over this hearing relied heavily on Deputy Hagen's false testimony(See exhibit 4A and 4B). I was subsequently convicted of 2nd degree DWI in a jury trial based primarily on the testimony of Deputy Hagen. It's also worth noting that Deputy Hagen was suspended in July 2004 by his department for repeatedly giving false information in an investigation following a boating accident Deputy Hagen and an unknown colleague were involved in(See exhibit 5A and 5B). I had brought Deputy Hagen's perjured testimony to the attention of City Attorney Amanda Grossman in an email that I sent to her in May of 2022. Mrs. Grossman promptly dismissed my warnings without response(See exhibit 6A,6B,and 6C). I have attached still shots of Deputy Hagen's Body worn camera as well showing the points were my eyes were visible during the traffic stop. By promptly zooming the images you will see there is no bloodshot red or glassy eyes visible in these photos.
