I am submitting this statement for Brady/Giglio review regarding Sgt. Jonia Smith of the Clarksville Police Department. His conduct in multiple cases—including CKC-21-393 and CKC-24-172—raises substantial concerns about credibility, retaliatory enforcement, and constitutional violations that warrant disclosure under Brady v. Maryland and Giglio v. United States.
A key example is the publicly circulated bodycam footage titled “I Have I.D. – But You Ain’t Gettin’ It” by the Youtuber LackLuster, which documents Sgt. Smith’s roadside encounter with a citizen asserting their First, Fourth and Fifth Amendment rights. The video, while technically uneventful, is damning in its lack of professionalism, legal clarity, and restraint. Sgt. Smith fails to articulate probable cause, escalates without justification, and displays a confrontational demeanor that undermines public trust. The footage has been widely criticized and reposted, generating public backlash and calls to question his credibility in future proceedings.
Following the release of this video, Sgt. Smith became the subject of dozens of threatening calls—calls which the State itself attributes to third-party viewers, not to any direct action by the undersigned. Nonetheless, these calls were used to justify retaliatory no-contact orders and criminal charges, some of which were later dismissed or challenged on constitutional grounds. This pattern of enforcement—rooted in optics rather than law—reflects a misuse of authority and a failure to uphold procedural fairness.
Sgt. Smith’s name appears in multiple filings and exhibits that document retaliatory conduct, investigative irregularities, and public scrutiny. His involvement in cases now under constitutional review, coupled with the evidentiary disputes surrounding his actions, meets the threshold for Brady disclosure. Prosecutors have an ethical obligation to disclose credibility concerns that may affect a defendant’s right to a fair trial, and Sgt. Smith’s record demands that scrutiny.
I respectfully request that Sgt. Smith be reviewed for inclusion on the Brady List and do-not-call registry, in accordance with Arkansas POST standards and the constitutional mandates governing prosecutorial disclosure.
(it should also be noted that Sgt Smith does not respect citizens first amendment rights and will arrest them for disorderly conduct or blame someone else for third party actions)
