Statement

While riding my Harley and approaching an intersection I noticed a cop facing the opposite direction to my left. When I got to the intersection the light was red so I stopped. The officer I just saw had positioned himself behind me had put his lights on while hitting his siren. I acknowledged he was there by turning my head towards him and motioned with my free hand(throttle hand) towards the light that it was red and across the road that I would proceed the best I could that I would proceed when the light turned green. I then played my free hand on my lap as to not act as I was attempting to flee. As I sat there officer rob budwick ran up on me and grabbed me with both hands screaming in my face telling me to shut it down repeatedly. He then began to pull me harder and harder causing me to dump my bike in the middle of the intersection. He then forced me to the front of his cruiser telling me to put my hands on his bumper. After a verbal exchange between the two of us, his partner(officer john ruby) showed up and budwick arrested me for failure to comply and placed me in handcuffs. He then put me in the back of his cruiser for around fifteen mins while he conferred with his colleague. After they conversed he then released me from custody free to go with no tickets. I then filed a complaint with the town and collected the body cam footage which I have in my possession. I also have the footage on my YouTube channel (hellomynameisjimmypop) I wasn’t able to upload the footage to your page, it may be too large. I was able to unload a still shot of the exact time he put hands on me and you can see proof that my throttle hand is on my lap, the while you see near my tank is the white on the thumb of my glove.

New York Freedom of Information Law

Article 6 (Sections 84-90)

The New York Freedom of Information Law is a series of laws designed to guarantee that the public has access to public records of governmental bodies in New York. New York’s first such law was passed in 1974 but that law was repealed and replaced in 1977 with a significantly changed law. Important amendments were then made to the law in 1982, 2005, and 2008. A record is defined as any information kept, held, filed, produced, or reproduced by, with or for an agency or the state legislature, in any physical form whatsoever. Documents are still covered by the act if a promise of confidentiality has been given, if they are in temporary possession of someone else, or if they originated outside the government but have come into possession of the government.

Anyone can request records in New York. A statement of purpose is usually not required but several New York courts have considered the requestor’s motives to be relevant where the motive of the document requestor was to obtain documents relative to pending litigation. The New York Freedom of Information Law also allows agencies to deny requests for lists if the lists that would be obtained would be used for commercial or fundraising purposes. However, there are no restrictions on how public records may be used, once they have been obtained. Allow five days for a response to a public records request.
