Ptl. Jacob Freeman came to my residence to serve me with a "Stalking Warning Letter", stating that I am stalking a woman that has repeatedly filed false police reports against me. I have multiple witnesses to her admitting she tried to beat me because I verbally confronted her about bullying my child with autism online, as well as her trying to share personal information about me in an attempt to have me physically and virtually harassed. The woman ran towards me and started to punch me. I caught her hands and held her in place to avoid fighting with her. I did NOT want an altercation. After her fiancé, Michael, pulled her away because I urged him to get her back, she went inside of the house, grabbed both of their phones, and recorded herself calling dispatch and claiming I beat her while she is pregnant. She also had her fiancé say the same in a written statement, and he willingly did it because I am his ex. He harassed and shamed me ever since I rejected him, which I have video proof of, as well as screenshots from social media/saved messages in the apps themselves. Anyway, after this woman got with my "ex", she tried to add me to social media and speak to me, which can still be seen on the messenger app if any officer would actually investigate. I usually blocked her, but sometimes it is hard to keep up because she makes new accounts on a regular basis. As their relationship progressed, she sent me alarming messages, such as a video she claims another woman sent her-featuring a child's voice in the background while a second woman excitedly explains she has found my car and is filming it for others. My car also happened to be vandalized on multiple occasions after the videos/images of it circulated, and I ended up having to sell the car and get a new one for relief. Furthermore, this woman (my alleged victim) made whole accounts just to "blast" me online with, and these accounts featured personal information about me, and pictures of my child with autism- claiming she is in danger. These accounts garnered attention with screenshots of me, and edited videos filmed by my ex, intended to make me appear crazy, like a bad mother, etc. Most importantly, these accounts also featured the video of the woman filming herself calling the cops, which I never could have gotten a copy of considering she filmed it, and decided to share it herself on her own social media. She told the police the accounts were actually me-trying to just make her look like she is harassing me, yet they have videos I have never had copies of. And why would I want the public to see a video of a woman crying and lying about me? That doesn't even make sense because it is embarrassing . I have a myriad of evidence against this woman, including witnesses to her admitting to lying to the police about me, yet nobody tries to help me. She even went so far as to file false cps reports against me, which I overcame, but it is absolutely ridiculous that this woman is continuously allowed to file false reports about me with no repercussions. The warning letter states if I "stalk" her again, I could be arrested, but I have never actually stalked her. Whenever I did verbally confront her the one time in the past, I was told to come talk to them, but now I see this woman and my ex baited me because she is insecure, racist, and jealous. As I told Ptl Freeman, I have not seen this woman since that day she lied, except for once in a store. I have definitely not stalked her. I say this woman is racist because I have showed the police images of her using racial slurs on social media, and because she thinks since I am part Mexican and have a Hispanic name, she can just lie about me and get away with it. She wields her light-skinned privilege like a sword against me. When Ptl Freeman served me with the letter, I explained to him that I have evidence to show how the woman he claims to be my victim, has actually been the one taunting me and bullying my innocent child online. I asked him how he could possibly claim I am stalking anyone I am never around. He told me the woman feels intimidated/harassed by me and it falls under the statute for stalking (Section 1173 of Title 21). Yet when I pulled the statute up, it states "Harassment does not include constitutionally protected activity or conduct that serves a legitimate purpose". Because I have never received any help from legal enforcement in regards to this woman filing false police reports, cps reports, sharing my personal information, I did make some videos warning the public, but especially Hispanic people to stay away from this woman, her friends, and anyone else involved. I explained to Ptl Freeman that he is infringing upon my First Amendment Right to freedom of speech/press by claiming I am stalking someone just for sharing my side of these issues and warning the public. If people are going to get away with making endless accounts of me, I should be able to publicly respond and express myself and my experiences. I do not slander the woman in these videos. I share public records, police reports, etc- documents and images anyone else in the world can get online. Ptl Freeman agreed he can't tell me what to post if it is already public/public record, yet he still served me with paperwork and "warned" me about my actions. But again, the current statute states stalking doesn't pertain to constitutionally protected activities (i.e.-expressing myself /freedom of speech). The statute specifies stalking as unconsented contact, and I have never contacted this woman unless she contacted me first. More importantly, I usually blocked her and ignored most of her attempts at contact. It also describes instances of physical stalking, which again, I have never done and there is NO proof that I have. The issue with me verbally confronting her has already been legally resolved through the DA's office, and she should not be allowed to use an instance that has already been closed out. Also, Freeman stated he could not tell her what to post on social media either, but the difference between what she posts vs. what I post is she posts slander based on things my ex has claimed, while my videos and posts have featured public records and images. There is a difference. Ptl Freeman told me he did not want to write a biased report against me, yet instead of coming to find me first before writing his initial report, he served me the letter first. He did take a new statement from me and an email featuring evidence against the woman, but again, this situation feels like a racial bias is being used against me considering Freeman took this woman's word for it without any real evidence, and only added my evidence as a supplement for the DA's office to read. Freeman said his report will still be sent to the DA's office, so they can decide what to do, but I have had to write a Brady entry on one of them before. I told Freeman they all take her word for it without tangible evidence because she is a Caucasian woman who uses her tears and acting skills, and she never has to provide hard evidence- they just take her word for it. On the flipside, me, the Hispanic woman with two master's degrees, has to have every last thing documented to even stand a chance at justice. This woman nearly ruined my life with her false report of domestic abuse. I had to hire an attorney and get it dismissed and erased just because the police taking the report did not even look at my evidence. I overcame that situation, after I was treated like a criminal. Now, my civil rights as a human are being infringed upon because it is easier for these officers to exercise a racial bias and deem me a "hot-headed Latina" , as opposed to holding this woman accountable. On a related note, she also accused her fiancé of domestic abuse, and he was arrested this year, which can be found in public record. This is the same man who willingly wrote a false statement claiming I beat this woman. I also explained to Ptl Freeman that my record was recently cleared of her false claims, and I felt like the stalking story was just an attempt to try and get me in trouble again since her first attempt didn't amount to a conviction. The timing is just odd, especially considering my videos have been up for several months now. It is NOT illegal to hurt someone's feelings with the truth, but it is illegal to impede upon my constitutional rights just because this woman wants to suppress the truth and be allowed to bully me and my child. These people even appeared at my college graduation and yelled obscenities at me after telling me and my mother that they would get me kicked out of college. This group needs to be held accountable. I told Ptl Freeman at this point, I am terrified she will lie again and claim I stalked her following this letter, putting me back where I started on having to prove myself and clear my name. This is getting exhausting. I do not care what the woman says about me on social media, but I do care she lies to the police in an attempt to get false charges filed. I have attached the following evidence, and if any is inappropriate, please remove as you must: 1. Video from woman claiming I stalk her-featuring a group filming MY car. This video was circulated. 2. Video of Michael complaining about me standing him up. He was with my alleged victim after me, and together they have bullied me and my child online. He is also the one who is now on probation for "domestic abuse" against this same woman. 3. Screenshot of a Tiktok account where my alleged victim shared a multitude of videos of me and my ex, and urged people to file false cps reports on me. In other words, besides bullying my child online, she has tried to get my kids taken away from me for no reason than to be petty and spiteful. My kids are not and have never been in danger. I did submit even more evidence to Ptl Freeman himself. However, I feel it is far too personal to share with anyone publicly, considering it features images of my kids, but I am happy to share them with anyone that needs them to provide me with resolution/further steps. Lastly, I must add the interim police chief, Joe Clark, also signed the warning letter, which means Ptl Freeman had a superior also exercise a racial bias and sign off on no real proof that I have stalked anyone. When I pressed Ptl Freeman for what evidence he apparently has against me, he only cited my videos of public records as the evidence, which again, falls under my freedom of speech. I have been nervous about the woman fabricating evidence or acting out, but he assured me it was only based on my public videos about my experiences; hopefully the story doesn't change once I actually get a copy of Ptl Freeman's report.
