I am writing to formally file a complaint against Detective Perez 858 for severe misconduct and alleged collusion with Enterprise Rent-A-Car employees, resulting in significant violations of my rights and a disturbing miscarriage of justice. I have outlined the chronological account of events below, including recent developments as of January 23, 2023: June 7, 2017, I rented a 2017 Dodge Ram from Enterprise Rent-A-Car at 12940 Firestone Blvd, Santa Fe Springs, CA 90670, referred by the area Manager and a close friend named Franklin P. Perkins, whom I've known since high school class of 2001. However, Perkins manipulated the rental agreement by falsely registering his credit card on my account without my knowledge or consent, resulting in an overcharge of $1,845.97 instead of the correct amount of $1,440. This misconduct occurred for personal gain, and I was unaware of this fraudulent activity during the rental process.. October 31, 2017,Franklin P Perkins placed his Discover credit card on file for the Cali Karts business to be able to over charge me. I was never told to place a credit card on file . It was declined for the monthly payment. Unbeknownst to me, Franklin P. Perkins, who had Franklin P Perkins doing this he would be able to charge me $1845.97 instead of the correct price of $1440.00falsely claimed it to be mine. Perkins orchestrated this deceptive act to keep his job secure and evade arrest, all while I remained oblivious to the unauthorized use of his credit card, believing I was making legitimate payments for the rented vehicle at Enterprise Rent-A-Car. Subpoena records would later substantiate Perkins' involvement in this fraudulent scheme, and I was consistently provided with receipts, unknowingly documenting the financial deceit. December 18, 2017:Mr. Perkins filed a false police report at the Whittier Police Department against case number 2017-00904343. Reporting officers 352-GUERRA / 211-N FLORES. December 28, 2017: Felony stop and arrest by LA Sheriff Department Deputy Lopez 610204, charged with 10853 (F)VC for the truck rental from Enterprise Rent-A-Car. December 30, 2017: Bond posted, released on bail with an upcoming court date on January 23, 2018. January 23, 2018: No case filed; District Attorney confirmed no refiled case as of March 2, 2023. February 8, 2018: I received CERTIFICATE OF EXONERATION OF BOND for my 10851(A)VC Case arrest date December 28, 2017. No Case Filed. March 15, 2018: Enterprise Rent-A-Car Employee Alexis Torres would list my Cargo Glider for Sale for $800.0 on offer up and i had to just see it . I would be told every week I could pick it up once Marco Espinal called me and arranged a time clearly that was false. I made an offer on the item, and once Alexis Torres gave me the location address, which was Enterprise Rent-A-Car 12940 Firestone Blvd, Santa Fe Springs, CA 90670, and a cell phone number, I responded, informing them I was the owner of the cargo glider and they had no consent to sell my personal property. I requested it to be removed, and I would be sending someone to pick it up. I would be allowed to pick it up a few days later, so I had a friend go, and due to it being left in the rain, it would be damaged, and no longer be able to be used. I was told that the manager would be filing a police report and if I wanted to press charges, they would give the officer my phone number; it never happened. September 20, 2018: Felony complaint for an arrest warrant filed against me at Bellflower courthouse by DETECTIVE PEREZ 858.The police report used was the same one filed on 12-18-2017, while that case would not be Refiled on 1-23-2018.Detective Perez 858 would commit perjury by filing complaint like it was my first charge.Failing to disclose everything that has happen. December 18, 2018: Learned about an outstanding warrant, turned myself in, and the warrant was lifted. May 20, 2018: Court denies dismissal request due to false testimony by Perkins. June 10, 2019: I went to the Los Angeles District Attorney and asked how I was able to be charged twice in the same incident. The DA informed me that a new case with Enterprise was filed and the incident on 12-28-2017 is not refiled by the DA. I would be given a District Attorney Declination letter signed by Richard Doyle, Head Deputy District Attorney of Compton Branch Office. July 30, 2020: Case dismissed for the second time. After my Public Defender Michael Solis would write a letter to the DA Mr. Villa informing him that Mr. Perkins has been telling false information. First, the demand letter sent to me on 12-11-2017 by Employee Elizabeth Mendoza was false; the FedEx tracking number 778718837187 would never be used for me. It was used months earlier with another customer on March 22, 2017, between Elizabeth Mendoza and another customer. Attached are the FedEx subpoena records and the demand letter with the tracking number. Elizabeth Mendoza would withhold the information when Attorney Solis requested it since Elizabeth Mendoza was in charge of the records department for Enterprise Rent-A-Car. Also, Attorney Solis would provide DA Mr. Villa Franklin P. Perkins' wedding picture, which I was in since I was his groomsman for Mr. Perkins' wedding, and my District Attorney Declination letter signed by Richard Doyle, Head Deputy District Attorney of Compton Branch Office. The DA dismissed the case. April 26, 2021: I filed charges against Enterprise Rent-A-Car employees, Franklin Perkins, Elizabeth Mendoza, Walter Galvan, and Alexis Torres and gave Gomez 767 all the evidence and Public Defender Michael Solis' contact information since he offered to assist if needed. Case number 2021-00901114 would be approved by Sgt. Ponce #375 and D. Garcis #809 on May 3, 2021. The case was never investigated, and I never spoke to Gomez 767 again after April 26, 2021. July 28, 2021: I went to Whittier Police Department to follow up on my police report filed by Gomez 767. The front desk employee would tell me to head over to Santa Fe Spring Police department, so I did. I was introduced to Detective Yoshitake and once again gave my statement and all the evidence I had. July 29, 2021: Detective Yoshitake would call my public defender and leave a message for a call back. My public Defender emailed me requesting approval for him to talk to Detective Yoshitake; I called and told him yes, give them anything they need. Detective Yoshitake never answered nor returned Attorney Solis' call. The following weeks I would call and leave messages. I finally was able to get Detective Yoshitake on the phone, and he would apologize for not getting back due to a lot of Homicide that was going on. Detective Yoshitake informed me if I wanted to press charges against Mr. Perkins I would have to call him on a 3-way and get him to confess his actions. I replied we are no longer friends, and I'm pretty sure he blocked me. Detective Yoshitake would inform me it will be tough, let me speak to the DA, and I'll get back to you. November 15, 2021: I Would file a lawsuit against Enterprise Rent-A-Car and Franklin P. Perkins Case 21NWCV00756, which became hard since I had no documents of the outcome of my investigations. March 15, 2022: I would stop by the Santa Fe Springs Police department with no call back from Detective Yoshitake nor Officer Gomez 767. I would be told to leave my phone number Detective Yoshitake will be informed I stopped by. I never received a call back. About July 2022: I would stop by the Santa Fe Springs police department requesting an update. I was told to go to the Whittier police department, and someone can help you there. I would go and meet another officer. I would give him a copy of all my documents, and he said, let me call Detective Yoshitake, so I waited. After a few minutes, he came back in and told me was Detective Yoshitake and informed me that I was over my statute of limitations. The officer told me to leave a copy of my documents and if there is anything he can do he will call me; it never happened. December 20, 2022, My civil case i had to response to DEFENDANT FRANKLIN PAUL PERKINS' Attorney's FIRST SET OF REQUESTS FOR ADMISSION TO PLAINTIFF ISMAEL RIVERA, I contested the statements related to the discovery of my Cargo Glider's listing on Offerup.com and Perkins' alleged claim of truck theft on September 20, 2018. I clarified that I had evidence of the Cargo Glider being listed on Offerup.com but still lacked proof of Perkins filing charges on 9-18-2018, as he had denied any involvement during his testimony against me. January 6, 2023, I visited the Whittier Police Department to follow up on case number 2021-00901114, providing my contact information for Gomez 767 to reach me. I also requested the 9-18-2018 police report used to file 487 GTA against me, and though informed it would take 10 days, I awaited further communication.. January 23, 2023: I stopped by the Whittier police department since I did not hear from anyone so I stopped by and I was given my police report 3 page police report for my case and arrest on 12-28-2017 this report had nothing to do with 9-18-2018 which had no police report on file. February 10, 2023: I filed a formal complaint against Detective Perez 858 and requested an investigation on how the case was handled. The case would be signed to Sgt. Ramos. February 26, 2023: I would speak to Sgt Ramos and inform him there was no police report for the case filed on 9-18-2018. Sgt Ramos responded with sure there is, and if I would be able to go back today and get it and will start with that first. I headed down to Whittier Police Department and I would speak to Deputy Collins and request a copy of the police report on file and inform him Sgt Ramos told if there was any issue to call him. Collins asked me for my phone number and told me they will have it ready sooner than 10 days. I said thank you then left. February 27, 2023: Sgt Ramos called me again and asked if I received the police report. I informed him that they told me in 10 days. Sgt Ramos asked me if I could meet him at Whittier Police Department before 4:30 pm since he was off, and I told yes I will meet him so we can get the copy of the 9-18-2018 police report. Once I arrived and met with Sgt Ramos, he would go and loom for the police report, and after 30 mins he would bring me to a small office and give me a 3-page Whittier Police Department Supplemental Narrative Report that was printed by Police Sander on 2/27/2023 at 15:11 hours. Sgt Ramos told me this case is messed up but it's the DA's fault not Detective Perez 858 and told me now that I gave you the copy of the report we can both agree to close this case. I responded with no, please do the investigation; there is something wrong. We shook hands, and I left. ‘March 2, 2023: A visit to the District Attorney's Office requested updated information on the case. I was given an updated Attorney Declination letter, Decline letter which stated no case filed for the incident on 12-28-2017. March 21, 2023: My attorney told me to request the complaint filed on 9-18-2018 from my Public Defender Michael Solis, so I did. March 22, 2023: Public Defender Michael Solis emailed me the Complaint, and the person that filed it was Detective Perez 858. I Called Sgt Ramos and told him I had updated evidence that the complaint was filed by Detective Perez 858 and if I could email him the documents. Sgt Ramos told me I don't understand the DA at fault. I'll let you know once the investigation is completed. Awaiting updates on police reports filed with Gomez 767 on April 26, 2021, and my complaint filed against Detective Perez, being investigated by Sgt. Ramos.Despite my continuous efforts to seek justice and closure, I have yet to receive updates on these crucial matters. I am increasingly concerned about potential rights violations and the lack of due diligence in these investigations.I urgently request your intervention to expedite the investigations, ensure transparency, and uphold the principles of justice.
