Complaint

Statement

•Detective Leonard Kubilus spent less than 1 minute in Chance Edmiston's home.
*When inside Chance Edmiston's home, Detective Leonard Kubilus is seen on body cam seemingly attaching a gun (as if he didn't wear one in) to his holster AND stuffing something in his back pocket. This scene occurs in the kitchen
*Did Not cordon off the scene
*Did not review the paperwork laying out on the kitchen table
*Did not open the pantry which had attic access, which was also the door directly in front of him while he was in the kitchen
*Did not "detect" at all
•Detective Leonard Kubilus lied to multiple persons and entities, stating there was supposedly a witness who saw Chance Edmiston take his own life. This is untrue and the “supposed witness” verifies this is untrue right on the bodycam footage. This lie flowed into the EMT Report, the ER Report AND the Coroner’s Report… a lie started by the main detective on Chance Edmiston’s case.
•Detective Leonard Kubilus ignored a lead in which one person stated multiple times in one conversation they believed they knew who caused Chance Edmiston's death and why.
•Detective Leonard Kubilus had his first conversation with one important person on scene, off bodycam.
•Detective Leonard Kubilus sat directly on the “supposed” gun evidence while inside Deputy Clenin's car.
•Detective Leonard Kubilus removed multiple sticky notes from the sticky note pad, and stuck them on the car dash, in which one fell on the floor, was found later and thrown into the passenger seat of the car
•Detective Leonard Kubilus’ only form of note taking while on scene was a sticky note pad borrowed from Deputy Kyle Clenin. A detective really came to the scene of a violent death this unprepared.
***Detective Leonard Kubilus stated Chance Edmiston was a suicide, before EVER VIEWING Chance
*Detective Leonard Kubilus admitted to Chance Edmiston’s attorneys in 2023 that he did not see a gun at all in the surveillance video, yet, he would not investigate Chance Edmiston’s death as a potential homicide.
•Detective Leonard Kubilus did not make one note in Chance Edmiston’s case file until October of 2023, 3 months after Chance Edmiston’s death.
•When Detective Leonard Kubilus finally made notes in the Paper Discovery three months after Chance Edmiston’s death, he falsified his portion of the Paper Discovery and the “forensic” information he included, as three months prior, the ER doctor, the only person with a medical degree who touched Chance Edmiston’s case, and the EMTs, had already stated in writing, the shot was from the left. Chance Edmiston was right-handed.
Note: It is our belief Detective Leonard Kubilus went to the scene of Chance Edmiston's shooting high because:
1. He could not make eye contact with other 1st responders
2. He was in a rush to leave the scene to "go get something" (another hit?)
3. He pulled the sticky notes off the pad and stuck them all over the dash
4. He was spinning his wedding ring inside the house (unnecessary fidgeting)
5. He was fidgeting with the sticky note pad in the yard (unnecessary fidgeting)
6. He sat on the "supposed weapons evidence"

•The paper sack that originally contained the “supposed” gun evidence on scene, was disposed of. This crucial piece of evidence never made it to the evidence locker. This paper sack should have contained blood and debris from the weapons evidence which Deputy Kyle Clenin “states” he recovered from the crime scene.
•Per the bodycam video, no such blood and debris is contained within the paper sack that is later discarded instead of being entered into evidence
*The "Supposed Weapons Evidence" has been swapped or cleaned since 20+ days AFTER it was supposed to be in the HCSO evidence locker
