The US Attorneys Office for the Eastern District of Oklahoma issued a Giglio Letter to Sheriff Anthony Louie, District Attorney Erik Johnson, and US Attorneys for the Northern and Western Districts of Oklahoma as notification of known credibility issues related to Chris Perteet Sr.

The Giglio Letter stated:

Pursuant to Giglio v. United States, 405 U.S. 150(1972), the United States is obligated to produce information to a defendant which may be used to impeach a government witness' testimony in a criminal trial. In that vein, it has come to the attention of this office that Seminole County Sheriff's Department Investigator Christopher Perteet, Sr. was terminated from the District 22 District Attorney's Office in January of 2024 for misconduct including theft of controlled dangerous substances evidence, mishandling of controlled dangerous substance evidence, illegal drug use, and inconsistent statements concerning illegal drug use. The termination bears on Perteet, Sr.'s credibility. Consequently, in all future cases in which Perteet, Sr. is endorsed as a government witness, the United States is required to notify the defendant of the memorandum.

Additionally, Former 1st Assistant District Attorney for Seminole County, Candace Irby, took the ethical steps of disclosing the U.S. Attorney's Giglio letter prior to resigning from District Attorney Erik Johnson's Office.

Oklahoma Open Records Act

Title 51 Oklahoma Statutes § 24A.1 et seq.

The Oklahoma Open Records Act is a series of laws designed to guarantee that public has access to all public records of governmental bodies. Section 24A.2 defines records as "all documents, including, but not limited to, any book, paper, photograph, microfilm, data files created by or used with computer software, computer tape, disk, and record, sound recording, film recording, video record or other material regardless of physical form or characteristic, created by, received by, under the authority of, or coming into the custody, control or possession of public officials, public bodies, or their representatives in connection with the transaction of public business, the expenditure of public funds or the administering of public property." This specifically includes all records of the transfer of public funds.

According to the Oklahoma Open Records Act, anyone may request public records and no statement of purpose is required. However, if the purpose is commercial, fees will be charged for document collection. There is no restriction on the use of records and the law does not specify a time limit for responses to requests.
