I am submitting the following information and request that Sgt. Jason Hall of the Grayson Police Department be placed on any Brady/Giglio list maintained by your office. This submission is based on publicly available body camera footage, court records, and reporting that demonstrate conduct by Sgt. Hall that directly impacts his credibility as a witness and raises serious concerns under Brady v. Maryland and Giglio v. United States.
Summary of the Incident
On or about [approximate date if known; otherwise “in or around early May 2026”], Nathan Stephens was involved in a minor, non-alcohol-related traffic incident in his neighborhood in Grayson, Kentucky. Mr. Stephens does not drink alcohol.
Grayson Police Department Officer Bell responded and accused Mr. Stephens of driving under the influence, claiming he could smell alcohol. Mr. Stephens voluntarily submitted to a Preliminary Breath Test (PBT), which returned a result of 0.00 — conclusively showing no alcohol in his system.
Mr. Stephens then performed standardized Field Sobriety Tests (FSTs). He passed the tests. Officer Bell acknowledged on scene that Mr. Stephens had passed the FSTs. Initially, the officer indicated that Mr. Stephens would not be going to jail for DUI because he had cooperated and taken the tests.
However, after Mr. Stephens stated that he would have sued the officer if he had been arrested, the two officers on scene (Officer Bell and Sgt. Jason Hall, the supervising officer) covered the body camera and had a private conversation off-camera. Following that conversation, the officers changed their position and arrested Mr. Stephens for DUI anyway. He was handcuffed and transported to jail despite the 0.00 PBT result and his passing performance on the FSTs (which the officer had already admitted).

Mr. Stephens prevailed in court on the charges arising from this arrest.
Sgt. Jason Hall’s Involvement and Credibility Issues
Sgt. Jason Hall was the senior/supervising officer present during the entire encounter. Public reports and commentary on the incident, combined with the body camera footage, establish that he was one of the two officers who:

Participated in covering the body camera and conducting a private conversation after Mr. Stephens mentioned a potential lawsuit.
Then proceeded with (or approved) the DUI arrest despite clear, objective, and acknowledged exculpatory evidence (0.00 PBT and passed FSTs).

This conduct raises multiple serious credibility and constitutional concerns:

Arrest without probable cause / in bad faith — Officers ignored definitive scientific evidence of sobriety and the on-scene admission that FSTs were passed.
Retaliatory arrest — The decision to arrest was made only after Mr. Stephens referenced suing the officer, followed by the off-camera huddle.
Body camera interference — Covering the camera and/or microphone during a critical decision-making moment constitutes potential evidence tampering or an attempt to avoid creating a record of the discussion. This demonstrates consciousness of the weakness of the case and a willingness to circumvent accountability measures.
Supervisory responsibility — As the senior officer on scene, Sgt. Hall had a duty to ensure constitutional policing and proper documentation. His active participation or acquiescence in the above conduct implicates him directly.

This incident provides strong impeachment material. In any future case in which Sgt. Hall testifies or provides information, defense counsel would be entitled to this evidence to challenge his credibility, bias, truthfulness, and adherence to proper procedures. It shows a willingness to effect an arrest despite clear evidence of innocence and to take steps to limit the record when accountability is threatened.

Sgt. Jason Hall be added to your office’s Brady/Giglio list (or equivalent system for tracking impeachment material).
This information be disclosed to defense counsel in any pending or future case in which Sgt. Hall may be a witness or involved.
