This complaint alleges that Mary Robnett, the elected Pierce County Prosecuting Attorney, has maintained or permitted an ongoing pattern, practice, or office policy of failing to identify, review, preserve, and disclose Brady/Giglio impeachment material concerning Pierce County Sheriff Keith Swank and any other law-enforcement officer who has been, is, or may be called as a prosecution witness. The alleged nondisclosure is not limited to Sheriff Swank or to a single prosecution, but reflects a systemic failure by the Pierce County Prosecuting Attorney’s Office to disclose favorable impeachment information bearing on law-enforcement credibility, bias, official misconduct, reliability, truthfulness, or investigative integrity. Publicly available credibility-relevant information concerning Sheriff Swank and other law-enforcement witnesses should trigger office-wide Brady/Giglio review, notice to affected defendants, and timely disclosure where required. This pattern and practice deprives accused persons of constitutionally required impeachment evidence and warrants formal investigation, corrective disclosure, policy review, and appropriate disciplinary or remedial action.
