10/14/2023 at approximately 2231 hours 911 call made by Phillip kirkey 13 yrs Married No prior DV cases known Phillip A Kirkey 5'8, 140 pds Hailey kirkey 5'4, 130pds 4 Minor children present on property but in the home no witnesses. Officer Ellis. B was assigned to call Brady list officer Corporal Fiksdal, with another officer visited Hailey police officer in report Benjamin C Ellis states, "PHILIP KIRKEY (S1) called 911. He reported that, his wife, HAILEY KIRKEY (V1), attacked him, hit him, and she tackled him to the ground. PHILIP KIRKEY (S1) had left their residence at 2010 Front Street, Trailer 31. Dispatch advised officer that PHILIP KIRKEY (S1) had left and would be walking to Food Pavilion where he would meet law enforcement. I went to the Food Pavilion parking lot but was then advised by dispatch that he was actually in Ferndale and I should start by phone. Phillip kirkey initial agreed to meet Ellis at the suggested place by officer Lynden police department but became scared Officer Ellis in report States, "approximately 2305 hours, he had still not arrived at the Police Department. I called PHILIP KIRKEY (S1) and he seemed like he was getting cold feet. He asked me what would happen if he came to the Police Department. I advised him I needed to see his injuries that he claimed to have and speak with him further. He told me he would arrive shortly. PLEASE NOTE AT THIS POINT OFFICER WAS MORE CONCERNED IN HAVING PHILIP MEET WITH HIM INSTEAD OF HIS SAFETY AND HEALTH. Philip had no legal obligation to comply. Officer could of advised him to visit the ER for treatment and pictures. Officer further states that Hailey has no visible marks just like Philip stated in the third call with officer Ellis, Phillip furthermore states "I feel like your going to arrest me" Ellis states not being cooperative. Ellis is a newbie Other two officers Lipton and fiskdal been in that community for many years. Kirkey family name was very known in this community for drug's these veteran officers are aware of that fact and know Phillip was the youngest and targeted this man for the sins of his father. Now deceased Larry Kirkey and brother are deceased (1 yr to that exact day of brothers suicide) 1 living brother who is still running a muck. These officers were pissed and retaliation and gender bias is occuring and training into new deputies. Bolo issued before any ticket was sent out. Wife informed to call 911 if he came back Following day on the 15th Hailey promptly calls 911 reporting estranged husband won't return their child, an Amber alert was issued officer Ellis called prosecutor seeking advices on child abuse and kidnapping as well, he was informed his behaviors weren't illegal but yes questionable. Officers went to his place of employment and arrested him He sat in jail with 4000 in bail for three weeks to monies were found to bail him out, showed to Court to be told to he should continue it due to normal judge wasn't present and convinced into sign a petition waive speedy trail. Records people are playing games and officers report are not available I am no lawyer BUT this is a internal officer problem false imprisonment and falsely arrested impowering a spouse who clearly was the aggressor and no sign of any violence occured that day or has it in the past. Philip is guilty of being born a kirkey in Lynden Washington
