06.10.24 Here are some concerns with examples regarding Officer Russell: A. As an Officer, there is a fundamental DUTY to PROTECT a. The innocent against deception, b. The weak against intimidation, c. And the peace against violet disorder B. As an Officer, there is a promise to keep LE’s private [and official] life unsullied a. To behave in a way that does not discredit oneself and the Department b. To behave with self-restraint c. To be honest in THOUGHT and DEED in one’s OFFICIAL and PRIVATE life d. To be exemplary in obeying the law Examples: 1. Officer Russell inflicted several instances of domestic violence, both physical and verbal (verbal has continued to this day), against his former spouse and in the presence of his children. Sadly, Avondale Police Department failed to properly investigate a reported incident, which oddly, was handed over to the Phoenix Police Department and Officer Brown (YOU) “unsubstantiating” the incident. This can appear to be a “favor” among those in uniform and for the purposes of losing a much-needed body patrolling the streets. Sadly, the children were never afforded the opportunity of an interview or appropriately questioned even after the display of urgent utterance, even when they can clearly seen on body cam footage (refer to https://photos.app.goo.gl/Zr2YUcxzhiYgsvEx9 for the actual footage) proactively interacting with the responding Officer, telling him that their father inflicted physical abuse against their mother in their presence. Also concerning is the jurisdictional issue, the poorly written report with missing information and some false information. Would it not be appropriate that more care and diligence is taken in investigation and reporting considering an off-duty officer and his family were involved in a domestic violence matter? This was not the first DV incident by Officer Russell against his former wife, but sadly was the first and only one reported for fear that those in uniform would not take any report seriously. A door was kicked in but somehow determined to be “old.” Why was the physical evidence that corroborated something occurring, along with the statements of the children, ignored? During this same DV incident, a wallet NOT belonging to Officer Russell was stolen from the marital home by Officer Russell. Officer Russell in fact did not have the right to enter the home, as his former wife was given exclusive use of the home by Court order. Officer Russell later acquiesced and returned the stolen wallet in exchange for no repercussions. A decision by the wallet’s owner was made not to press charges and discussed with the reporting Avondale police officer. How can Officer Russell be trusted to respond to calls involving DV? 2. To further prove abuse, there are several old, and one recent written communication [BELOW] from Officer Russel to his former spouse, stating,” if it were up to me, you would be dead.” This is not the first time Officer Russell uses death in a threatening manner. There is another text prior to marriage where he encouraged his former spouse to “kill herself.” Officer Russell’s physical harm may not be well documented, but his verbal abuse is in abundance and should be solicited for review and action. Some documented abuse can be accessed using the Google link provided above. 3. Officer Russell had several documented sexual affair(s) while married. Not only is this behavior deceitful, according to AZ statue 13-1408, extramarital affairs, albeit a misdemeanor, is still in fact considered a crime. a. There are videos available that were received by Officer Russell’s former spouse showing the following: i. Russell having sex with other women and some in the presence of others. ii. Russell performing acts of sexual gratification on himself alone (which means he recorded himself) b. Because the extramarital affairs were exposed to his former wife, Officer Russell retaliated against the participating parties who provided the proof and videos. Officer Russell explicitly threatens to retaliate [BELOW] by exposing them in other videos he had in his possession. There are texts available showing Officer Russell’s retaliation and where one party reminds him, he is a police officer. c. Officer Russell is clearly a sex addict – he is listed on most social media platforms and dating sites, targeting many women and at the same time. Review of his bank account statements (some are available to provide) will show money spent on and sent to random women, before, during, and after his marriage including: i. Fans only ii. Cash app iii. Venmo It is not appropriate to have Officer Russell assigned to a high school as a resource officer, placing him around young vulnerable woman. It can be shown Officer Russell is a sexual deviant. There are plenty of women to interview, but many are fearful of Officer Russell. 4. Officer Russell admitted in open court (transcript is accessible at https://drive.google.com/drive/folders/1sLBvUXqoYpOHukswScyciwwHXk94YgHg?usp=drive_link) that he filed fraudulent Federal tax returns for tax years 2021 and 2022 while separated, forging his former wife’s signature (by electronically filing and transmitting a tax return without her knowledge or consent), while also keeping all the tax refund benefits received for his exclusive use. In addition, through unsolicited receipt of tax documents through the mail of Forms 1099, W2G, and W2, Officer Russell failed to report all his earned income to the taxing authorities with intent and for the purposes of deception in his divorce proceedings. Unearned income hidden and not reported for both tax filing purposes and divorce proceedings was from significant gambling activities. Failure to report all income to the taxing authorities is tax fraud. 5. For tax year 2023, although the court order is silent, Officer Russell claimed one of his children. In the spirit of following the Federal tax laws when there is silence in state court orders, the fact Officer Russell was only seeing the children one night on average per week during 2023 (and not at all from April 2022 to November 2022), he would be determined the NON-custodial parent and unable to claim any child for he did not have more than 50% physical custody. Officer Russell did not have a signed release from the legal (as defined by Federal tax law) custodial parent, his former wife, to claim any of the children during any tax year where he was the non-custodial parent. By 9 pm on the first day of electronic filing acceptance for 2023, Officer Russell had already electronically transmitted his personal tax return to gain a disingenuous advantage over his former spouse. It can also be shown with his own corroborating texts that Officer Russell abandoned his family during 2021, 2022, and 2023 for extended periods of time and was absent from the home, therefore he would not be entitled to claim any child in 2021 and/or 2022 based on physical custody and support. 6. Officer Russell was recently present in court, May 2024, to answer contempt charges for not complying with the divorce marital settlement. Officer Russell hid financial accounts and to this date, has not paid the full amount owed to former spouse for temporary support and child support. Support Officer Russell stipulated to, which became an order of the Court, including the terms and amount of temporary and child support. Oddly, Officer Russell somehow managed to control these funds during the separation period by use of his debit card that he gave to his former wife to use, only to later spend the money and/or turn off the debit card when he wanted and accuse her of “fraudulent use”. The amount still owed by Officer Russell to his former wife is more than $8,000. An independent audit should be conducted. As of today, Officer Russell has also refused to execute the QDRO for the PDD retirement funds awarded to his former spouse, using legal maneuvers and delays to cause financial harm. This is also contempt, as the QDRO was ordered to be executed by October 2023. 7. Of MOST concern is Officer Russell continues to inflict mental and emotional abuse on his own children. The children have shared they are “afraid” of their father. School teachers have witnessed a decline in the children’s mental and emotional health but fear involvement resulting in a lawsuit and/or retaliation. Officer Russell’s ill conduct has been documented on many occasions. Please solicit this information and assign someone with professional qualifications to appropriately deal with protecting and serving children. Yesterday’s incident of throwing his youngest son’s special kindergarten graduation teddy bear out his car window, after an exchange of the children was made, for the child to see because of his anger and disregard for the child's mother, is a perfect example of disregarding his children’s wellbeing. A report was made to DCS regarding Officer Russell and the incident. If the appropriate criteria are met, DCS should be investigating Officer Russell for the abuse being inflicted (which is defined to include emotional and mental abuse). Again, how can Officer Russell be trusted to deal with children professionally if he can’t treat his own appropriately? 8. The Family Court ordered the use of a communication platform – “The Wizard” – since Officer Russell was unwilling and unable to communicate with his former wife/children’s mother. There is a plethora of documented harassment and examples of Officer Russell’s deficiencies on this platform. Please request and gain access for review. Officer Russell has even interfered with phone calls, which is documented on this platform. Yet, to this day, Officer Russell is obsessed with obtaining his former wife’s private (for safety purposes) phone number. Officer Russell has even recently muted outgoing calls from the children to their mother for purposes of confusion and to prevent communication, making it look as if the court ordered phone calls were adhered to. 9. Officer Rusell recently locked his children in his hot car for about 3 minutes during an exchange, causing panic among the children and their mother, to prevent mother from retrieving the children. He is obviously not afraid of authority, as demonstrated by this incident occurring in the front parking lot of the Avondale Police Department. Upon report to the Avondale Police Department, after the officer was notified that another officer was involved, they were reluctant to take the report. 10. Another text (BELOW) that supports Officer Russell’s true persona is where he says “fuck his” own grandmother (“Nana”) after she has expressed concern for the welfare and health of Officer Russell’s family, marriage status, his personal conduct, and behavior. There are many more extreme displays of anger and not just against his former spouse. 11. Officer Russell, although the Court ordered him to return a vehicle to his former spouse, to date still has not and refuses to disclose the actual whereabouts of this vehicle. Contrary to a text stating otherwise, he claims in another email to “know nothing about a car”. The vehicle was purposely and strategically issued a citation a year after he left the marital home in the City of Phoenix against the registered owner, his former spouse. There are texts supporting the fact that this vehicle was in Officer Russell’s possession; with texts showing he used it to go to and from work, prior to marriage, during marriage, and after the divorce was initiated. It appears it was also conveniently abandoned by Officer Russell once he purchased a new car. How does a vehicle disappear and later get cited which was being driven by a police Officer? Further research would indicate that “friends” in uniform “stumbled” across an abandoned car, cited it, and/or towed it. At a minimum, Officer Russell needs to retrieve and return the car to his former spouse (the rightful and legal owner of the vehicle) in the same condition as when he left the marital home for good in April 2022. This situation can be considered auto theft at this point in time. The fact that Officer Russell conducts himself in a deceptive manner personally, he will no doubt be, and likely has been, deceptive in his official capacity as a police Officer. 12. Sadly, Officer Russell’s mother has documented mental health issues and was treated in recent years in a psychiatric hospital. It is very possible there is a genetic predisposition for Officer Russell to experience mental health issues. It would appear the background investigation required to become a police officer was not very in-depth. Professionals say narcissists can also beat the system because they are good at portraying someone they are not. 13. Officer Russell has been scolded by family members who offered him a temporary place of residence because he failed to secure his department issued firearm and taser. There is a text from his uncle that demonstrates his carelessness in exercising safety. 14. It is also noteworthy to point out, Officer Russell lives with his mother in Goodyear, AZ, having the need of a nanny to care for the children while he works. He has stated in several text messages, which are available for review, that he would “never” leave his children alone with his mother for fear of harm. Yet, Officer Russell moves his mother to AZ after his divorce and condones her action of committing Social Security Income fraud, and other illegal indigent benefits. His mother is claiming she still lives alone full-time in a low-income government subsidized apartment in New Mexico. If Officer Russell’s mother is legally disabled, how is she able to care for children with or without compensation? It is very plausible that for Officer Russell’s sole benefit, he is participating in an arrangement with his mother that defrauds the Federal government. 15. To conclude, the use of the word “Nigga” by Officer Russell is unbecoming, repulsive, and discriminatory, regardless of Officer Russell’s heritage. The “gangster” persona portrayed in his civilian life is concerning. This conduct should not be tolerated, especially from a police officer. After outlining just a few documented and provable actions by Officer Russell, it becomes apparent why he refuses to allow his children to enter counseling/therapy; it is for fear of exposure of his actions to mandatory reporting parties by the most reliable and innocent truth-telling parties, his young children.
