Statement
On 08/07/2024 I the defendant appeared for an arraignment. A pre- trial conference was set for 09/24/2024. I appeared for the pre-trial conference but no police report was available to me or the prosucutor, Denise Boode. The prosecutor requested to continue the pre-trial conference to a later date (11/05/2024) to talk with me after the police was made available. I agreed. On 11/05/2024 I appeared for the pre-trial conference and waited to speak with the prosecutor, Denise Boode. The prosecutor, the prosecutor's paralegal, Robert Johnston, my wife Ava Nell Smith & I went all together to a separate room for a conference. Denise Boode and Robert Johnston refused to set at the conference table with me & Ava Nell. I said to the prosecutor that we have been looking forward to talking with her about details in the police report. At no time have I or my wife met or spoken with any prosecutor related to my charge. Denise Boode refused to discuss any details with me or with my wife Ava Nell. Denise Boode replied that we have already spoken together about details in the police report. Denise Boode expressed that she is not going to prosecute an assault charge against the plaintiff (Heidi Hake). Ava Nell & I had not ever mentioned any detail about an assault. Denise Boode said that all she needs is the police report and then offered me 3 years probation, anger management and restitution fines. Denise Boode said that I would have to accept that plea offer or go to trial. Denise Boode said that she has been to a lot of trials.
We all went back into the court room where I re-entered my plea and set a trail date for 01/21/2024.
The Payson Regional Justice Court policy is for a defendant and prosecution to converse details of a case to resolve issues before any trial. I was prejudicially denied a pre-trial conference and then coerced to accept a plea offer.i
