DDA Joshua Travis Martin #301450 prosecuted Mr. David Crawford for domestic violence based entirely on the statements of Ms. Capri who claimed she was strangled by Mr. Crawford. Ms. Capri provided DDA martin with a copy of a text message she claimed she sent to her therapist describing that strangling in the minutes after the incident. The defense raised concerns about the authenticity (creation date 75 days after Ms. Capri claimed, no record of it being sent in Ms. Capri's AT&T records, etc.) of that text via email from counsel Chuck Smith to DDA Martin on 12/2/2019. DDA Martin did nothing to investigate the reliability of Ms. Capri's evidence and the concern that it was falsified. Today, we know the text was falsified and that DDA Martin attempted to hide it by not entering it in to evidence at trial. DDA Martin violated his ethical obligation to investigate evidence that weighed heavily on the credibility of Ms. Capri's testimony - which comprised 100% of his case against Mr. Crawford. DDA Martin also set up Ms. Capri to be asked about this on cross-examination in which she confirmed her claim that the therapist text was authentic - a felony PC132/4 violation.
