The Colorado Court of Appeals overturned the assault conviction of Dominic Jorge Martinez after finding that Arapahoe County prosecutors engaged in misconduct by improperly commenting on his constitutional right to remain silent. During trial, the prosecution repeatedly emphasized that Martinez had not explicitly used the phrase “self-defense” when speaking to police, suggesting that his failure to do so indicated guilt. While prosecutors are allowed to question inconsistencies between a defendant’s statements and later testimony, the appellate court ruled that treating a defendant’s omission of specific legal terminology as incriminating oversteps constitutional limits. Martinez had told police that he acted out of fear when his mother and stepfather entered his room and attacked him, but he later described his actions at trial as self-defense. The court determined that the prosecution’s approach unfairly penalized him for not articulating a legal theory during his police interview, thereby violating his right to silence and undermining the fairness of the proceedings. As a result, the conviction was reversed and a new trial was ordered.
