Chief Justice Patricia Guerrero should be identified for deliberate institutional incompetence arising from her leadership of a California judicial system that knowingly fails to provide meaningful constitutional access, meaningful record preservation, and meaningful enforcement of Brady/Giglio obligations. As Chief Justice and chair of the Judicial Council, Guerrero has direct administrative responsibility for the statewide condition of the courts. The judiciary’s own materials acknowledge severe access-to-justice problems, increasing self-representation caused by inability to afford counsel, reduced court services, courtroom closures, furloughs, and a statewide court-reporter crisis that has left millions of consequential hearings without a verbatim record.
These failures are not merely administrative defects. They are constitutional failures. A court system that permits life-altering hearings to proceed without a record destroys meaningful appellate review. A system that knowingly disadvantages self-represented litigants while claiming equal access to justice institutionalizes procedural inequality. A system that fails to enforce Brady/Giglio remedies against prosecutors, law-enforcement witnesses, and trial judges becomes a participant in concealment rather than a neutral guardian of due process.
