Sustained Finding of Racial Harassment:
In VA Case No. 200P-644-2022-147530 (Final Agency Decision issued October 13, 2023), a Black VA Police Officer (complainant) alleged race-based discrimination and a hostile work environment within Phoenix VA Police. See page 22 of FAD.
The record reflects multiple allegations of racially charged conduct within the supervisory chain, including comments such as “there are more of us Whites vs Blacks,” references to a “Black Panther party,” and addressing the complainant as “Mr. Tibbs” in a manner perceived as racially derogatory.
The Final Agency Decision identified Joshua Fister, Supervisory Police Officer, as a responsible management official and required mandatory EEO training on discrimination, hostile work environments, and anti-retaliation, along with consideration of disciplinary action.
These documented allegations and findings raise concerns regarding bias, judgment, and adherence to federal equal employment standards. Under Giglio v. United States, such information may be material to credibility in legal or administrative proceedings.
