Statement

An allegation of First Amendment retaliation involving an engineered traffic stop carries severe implications for an officer's standing on a "Brady List." The traffic stop and retaliation trigger multiple explicit Brady and Giglio disclosure requirements.

The US Supreme Court extended the disclosure requirement to include impeachment evidence—information that could compromise a witness's credibility.

If an officer manufactures a traffic stop as a pretext to retaliate against a citizen (or their family member), any police report written to justify that stop is fundamentally dishonest.

Utilizing official police powers to carry out a personal or political vendetta constitutes structural bias and a lack of candor. Under Giglio, if that officer ever takes the stand in any future criminal case, the defense has a constitutional right to know that the officer has a documented history of fabricating or weaponizing enforcement actions.
