It is a foundational principle of legal ethics that attorneys, as officers of the court, are bound by a duty of candor, truthfulness, and integrity, both in professional and personal dealings. When an attorney exploits the credibility and authority of their legal position to unduly influence commercial transactions, such conduct may rise to the level of professional misconduct under applicable rules of professional conduct.
In the matter concerning Ms. Saab, it is alleged that she misrepresented the truth for personal gain and used her status as a licensed attorney to influence a commercial dispute, specifically by falsely asserting that a purchase was not as described in order to obtain a refund or other commercial advantage. If substantiated, such conduct may violate several provisions under the Michigan Rules of Professional Conduct, including but not limited to:
- Rule 8.4(b) and (c) – It is professional misconduct for a lawyer to:
- (b) commit a criminal act that reflects adversely on the lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects;
- (c) engage in conduct involving dishonesty, fraud, deceit, or misrepresentation.
- Rule 4.1 – In the course of representing a client, a lawyer shall not knowingly make a false statement of material fact or law to a third person.
- Rule 8.4(d) – Conduct that is prejudicial to the administration of justice may include using one's legal status to intimidate or coerce others outside the scope of official duties.
Such misuse of professional stature, particularly in a non-legal, private transaction, erodes public trust in the legal system. When an attorney implies legal authority or threatens legal consequence to gain leverage in a personal matter—especially while knowingly advancing a false claim—it can be interpreted as a violation of their ethical obligations and a potential abuse of process.
Should these allegations be confirmed, disciplinary action by the Michigan Attorney Grievance Commission or Attorney Discipline Board may be warranted. Such discipline could range from formal reprimand to suspension or disbarment, depending on the gravity and impact of the misconduct.
Parties affected by such conduct may submit a complaint to the Attorney Grievance Commission of Michigan, whose mandate includes the investigation and prosecution of attorney misconduct in the public interest.
