Statement

Three officers beat Dalvin Price while placing him under arrest. One officer repeatedly knees Price.

“The incident was a reported use of force by the involved deputies, which is currently being investigated,” the department said of the video. “All use of force incidents are thoroughly investigated, and the department will examine the tactics, policies and procedures at the conclusion of the investigation.” A department spokesperson said the officers remain on duty. The incident remained under investigation as of Dec. 9, 2021. The department did not respond to a request for an update in May 2021. “Due to the complexity, administrative investigations can take up to a year to complete,” the spokesperson had said initially. On Feb. 2, 2021, Price filed a civil lawsuit against the department and three officers. The department declined to comment on the pending litigation. In an answer to the suit filed in April 2021, county attorneys said the force used during the incident “was reasonable under the circumstances.” “The actual facts of this incident, particularly the genesis, are contrary to those alleged by Mr. Price. We look forward to the full and complete story of this event unfolding in the proper forum, a courtroom,” said Adam Marangell, an attorney representing Cuevas and Navarrete in the departmental investigation. Attorney Tom Yu, who has represented Barajas for the investigation into the incident, said that from his perspective, the use of force in the incident was “completely reasonable and justified under the law.” No charges have been filed against Price.
